GENERAL SALES CONDITIONS
Article 1: Generalities, scopes of application and concerned public
The present general conditions of sale apply to all the transactions concluded through the websites of the network of the SARL PATRIMOLAND. They are intended to define the rights and obligations of the parties in connection with the sale of products on the internet, access to training and services offered by the "Seller" to the "Customer". Any order placed on line means and implies full acceptance of these general conditions of sale.
The person placing an order (hereinafter referred to as "Customer") acknowledges having read these general conditions of sale before any purchase. "Customer" means any natural or legal person, carrying out an order with the SARL PATRIMOLAND, validated via our secure payment platform, regulated by CB, check or in cash.
The SARL PATRIMOLAND has the vocation to propose a set of products and services which can, depending on the case, be addressed to professionals or individuals.
The customers of our products and the participants of our trainings must be over 18 years old for the physical and electronic products, the coaching services, the workshops, the training seminars... We do our best to restrict the access to our sites, products and services to minors. In addition, any subscription to our newsletters that do not meet the above age criteria will be immediately removed from our database as soon as this is brought to our attention.
The team of the SARL PATRIMOLAND (hereinafter referred to as "Seller"), in addition to its products, may present on its sites marketing and commercial information, which are neither a promise nor a certainty that the Customer will achieve the same results. Indeed, the results of the Customer depend to a great extent on his motivation, his personal investment and the implication to follow the advice provided. The results can therefore differ greatly from one person to another.
The Seller and the training presented on the sites of the SARL PATRIMOLAND can not be held responsible for the use that could be made by the Customer, as responsible person, of the information provided, in particular in these training programs.
The Customer declares to have read and understood all the General Terms and Conditions of Sale and, if applicable, the Particular Conditions of Sale related to a product or a service and accept them without restriction nor reserve. The Customer acknowledges that he has received the advice and information necessary to ensure that the offer matches his needs. The Customer declares that he is able to contract legally under the laws of France, or validly represent the natural or legal person for which he undertakes. Unless evidence to the contrary is adduced information recorded by PATRIMOLAND constitutes evidence of all the transactions.
These terms and conditions of sale may be changed at any time and without notice. It is the Customer's responsibility to inform oneself regularly of any change to these Terms and Conditions.
Article 2: Order
Any order placed on a site belonging to the SARL PATRIMOLAND implies the full and unreserved acceptance of these General Conditions of Sale.
Article 3: Price
The prices are indicated in euros all taxes included (TTC), except delivery and processing expenses of your order.
Outside France, the company reserves the right to ship or not to ship the products ordered. In some countries, customs duties, or other local taxes, or import duties, or state taxes may be chargeable in certain cases. These rights and sums are not the Seller's responsibility. They will be at the expense of the Customer and under his responsibility (declarations, payment to the competent authorities...). The Seller invites the Customer to inquire about these aspects with the corresponding local authorities. The cost of telecommunication necessary to access to the Company's websites shall be borne by the Customer ; if applicable, the delivery costs as well.
The price of the goods, products or services offered may be changed at any time by the Seller. However, the rate applied to an order will be the one announced at the time of the order.
Article 4: Payment
Payment is due immediately on the date of the order, including for pre-order products. You can make payment by credit card (means that we prefer for security reasons), check or bank transfer. Secure online payment by credit card is done through our bank partner. The information transmitted is encrypted by state-of-the-art software and can not be read during transport on the network. Any guarantee as to the security of this system is entirely the responsibility of the bank and can not bind the SARL PATRIMOLAND.
Payment by bank check is only possible for checks in euros, drawn on a bank domiciled in France. In this case, the check must be made out to the order of "PATRIMOLAND" and sent to the following address: PATRIMOLAND - Allée Claude Debussy - BP 31 - 69131 ECULLY CEDEX - France. The check will be cashed five (5) days before the dispatch of the order, unless exceptional agreement, confirmed by the Direction of PATRIMOLAND.
Cards issued by banks domiciled outside France must be international bank cards (Mastercard or Visa). We do not accept American Express.
We also work with the recognized payment platform "PAYPAL". With this system, your payment by card is made directly on the secure server of PAYPAL. At no time will your card number, or any other confidential data attached to it, be disclosed to us. Only PAYPAL uses it to debit the Customer. The exchanges are encrypted and secured thanks to the SSL 3 protocol on the Internet, a protocol that has become a worldwide standard and that can be used by the main browsers. Once the payment has been validated by the Customer, after verification of the information, the transaction is immediately debited. In accordance with article L. 132-2 of the Monetary and Financial Code, the commitment to pay, given by card, is irrevocable. By communicating his banking information at the time of the sale, the Customer authorizes the Seller to debit his card of the amount relating to the indicated price. The Customer confirms that he is the legal holder of the card to be debited and that he is legally entitled to use it. In case of error, or inability to debit the card, the Sale is immediately canceled and the order canceled. The products ordered are sent only after payment has been received.
Article 5: Conclusion of online contract and delivery
The Customer must follow a series of steps specific to each product or service offered by the Seller in order to carry out his order, in particular:
- information on the essential characteristics of the product or service
- choice of the product or service, need be of its options; and indication of the essential data of the Customer (identification, address...)
- acceptance of these General Conditions of Sale
- verification of the elements of the order and, where appropriate, correction of errors
- follow-up instructions for payment, and payment of the product or service
- delivery of the product or service.
The Customer will then receive a confirmation, by e-mail, of the payment of his order, as well as an acknowledgment of his order. Delivery will be at the address indicated by the Customer; Therefore, pay close attention to the spelling of the address you enter, including the postal code. This delay does not take into account the time required to prepare the order. When the Customer orders several products at the same time, they may have different delivery times. In order to carry out the order properly, and in accordance with article 1316-1 of the Civil Code, the Customer undertakes to provide his verifying identification. The Seller reserves the right to refuse the order, for example for any application that he considers abnormal or suspicious, realized in bad faith; or for any legitimate reason.
In accordance with French law, the order is the subject of a summary and confirmation when validated. The parties agree that the illustrations or pictures of the products offered for sale have no contractual value. The duration of the validity of the offer of the products and their price are specified on the websites of the Seller; as well as the minimum duration of the proposed contracts when they relate to a continuous or periodic supply of products or services.
Unless otherwise agreed, the rights granted in connection with the purchase order are only granted to the individual signing the order (or to the person holding the email address).
Certain products can be downloaded immediately after ordering (except in the case of a deferred payment such as by a check, for example, after delivery; in this case the delivery is done after payment). The access instructions are sent to the Customer by e-mail immediately after validation of his order. In this case, the product is available in digital format via download link (via email and / or download page, in the Customer's member area).
In the event of delayed delivery, the Customer has the possibility to cancel the contract under the conditions and procedures defined in Article L.138-2 of the Consumer Code. The Seller then proceeds to reimburse the product and the transport costs under the conditions of Article L. 138-3 of the Consumer Code. The Seller shall provide the Customer with a telephone contact point (cost of a local call from a fixed line) indicated in the order confirmation email in order to follow up the order. The Seller recalls that at the moment when the Customer takes physical possession of the products, the risks of loss or damage of the products are transferred to him. It is the Customer's responsibility to notify the deliverer of any reservations he deems appropriate on the delivered product and to send the seller a registered letter by registered post with proof of recept within 48 hours to confirm any reserve with the necessary supporting documents (photos, testimonials ...). Without these elements, the Seller can not make any refund.
Moreover, the Seller can not be held responsible, in case of dispute concerning:
- the non-receipt of the delivery email due to the Customer's or his provider's antispam protection system, or incorrect information provided (example: erroneous email address) in the order form.
- the non-routing to the download page, because the Customer would have closed his browser before accessing it; Or would have closed it for any technical reason.
In case of non-receipt of the download link of the product, the Customer must contact the Seller by email to inform him.
The risks are borne by the Customer from the date when the products ordered left our premises. However, in the case of lost parcels, we will take all necessary measures to ensure that you receive your product; Or that you are reimbursed according to your guarantee.
The Seller reserves the right to suspend any order management and delivery in case of refusal of authorization of payment by credit card from the officially accredited bodies or in case of non-payment. The Seller also reserves the right to refuse to make a delivery, or to honor an order, from a buyer who has not fully paid a previous order; Or with whom a payment dispute is being processed.
The products remain the property of PATRIMOLAND until full payment of the price. The ownership of the goods remains with the Seller as long as the Customer has not paid the full price of the sale.
Article 6: Preorder
For pre-order products, ie those you can buy before their official release, the payment is due immediately, at the time of the order.
Estimated product release dates are not contractual. We do our best to meet the forecast dates, but actual dates often depend on factors beyond our control (eg printing, DVD pressing ...), so if you want to be absolutely sure that your Product will be shipped on a specific date, do not preorder! Just wait until the product is officially released, this will avoid unnecessary stress.
Article 7: Conditions of return and refund
In accordance with the legislation in force, you have 14 days from receipt of your order to exercise your "right of withdrawal". In accordance with Article L. 121-20 of the Consumer Code, "the consumer shall have fourteen clear days to exercise his right of withdrawal, without having to justify reasons or pay penalties, Exception, where appropriate, of the costs of return ". The Customer will be refunded the returned items within fourteen (14) days after receipt of the returned item. Transport shipping costs will be refunded only if the order is returned in full. In the case of a partial return of the order, the transport delivery costs remain the responsibility of the Customer. Returns of the products are to be made in their original state and complete (packaging, accessories, notice ...).
We have decided to increase this period to 30 days for all physical products (posters, engravings, published documents, books ...). However, some of the products and services we provide are not subject to this right of withdrawal. Article L.121-20-2 of the Consumer Code excludes in particular:
- training services (on-line or in DVD format) based on audio and video recordings,
- services, such as marketing consulting, if the service started within 14 days following the signing the contract.
In order for our customers to have no worries, we have taken the following decision: all our products and services, without exception, benefit from a guarantee of satisfaction. However, this guarantee differs depending on the product. Therefore, the conditions listed below are replaced by those specified on your order page for a given product, as the promises made on this order page take precedence over the conditions below.
Article 7.1: Concept of "necessary actions"
Some of our contracts are for training services. Our courses often contain action plans or recommendations, our Customers are asked to implement the required steps to achieve the competency or outcome targeted by the training. This before any reimbursement, PATRIMOLAND will therefore ask the Customer to present the proof of the realization of these "necessary steps".
This proof must be provided no later than 7 working days after PATRIMOLAND has acknowledged receipt of the refund request. If the Client is dissatisfied with the results provided by the training and wishes to obtain a refund, he / she will have show evidence of having carried out these "necessary steps".
Article 7.2: Conditions for reimbursement by product type
- Physical products (posters, books, DVDs, audio CDs)
Unless otherwise stated on the product's descriptive page, all of our physical products have a 30-day satisfaction guarantee. If you are not satisfied within 30 days of your purchase, return the product in NEW CONDITION to be fully refunded (excluding return shipping costs).
- Electronic products
Unless otherwise stated on the product's descriptive page, all our electronic products have a 30-day satisfaction guarantee. If you are not satisfied within 30 days of your purchase, simply contact us at firstname.lastname@example.org to request your refund * by mentioning your transaction number.

Unless otherwise stated on the product descriptive page, all our services (seminars, workshops, personalized coaching, telephone or email) have a guarantee of satisfaction of 30 days. If you are not satisfied within thirty days of your purchase, simply contact us at email@example.com to request your refund * by mentioning your transaction number.
Reimbursement also subject to the necessary steps (see Article 7.1)
Article 7.3: Return of Products
In case of receipt of defective or non-conforming products, we undertake to replace them, or to refund the amount of - the product (s) ordered. In this case, the Customer must indicate, on the same day of delivery or at the latest on the first working day following the delivery, any complaint concerning a delivery error or a non-conforming product, in relation to the indications on the order form. After this period, any complaint will be rejected. Any complaint not made in the rules defined above and in the time allowed can not be taken into account; and will release PATRIMOLAND from the Customer.
Attention, in the event of a complaint, the following rules must be observed:
- beforehand, contact us so that we can give you the information for the return
- return the defective or non-conforming products with the corresponding invoice (or at least the transaction number).
We will refund the cost of return if you return your order for a reason that is attributable to us: error of delivery, defective article... On the other hand, the return costs are not refunded to you if you return your order because you have changed your mind. Return should be addressed to:

A refund will be made by check or bank transfer (attach your bank details) within 30 days after receipt of the parcel.
Article 8: Availability and presentation
Orders will be processed within the limit of available stocks, or subject to stocks available from our suppliers.
If an item is unavailable for a period exceeding fifteen (15) working days, you will be immediately notified of the foreseeable delivery time; And the order of this article may be canceled upon simple request of the Customer, who can then request a credit for the amount of the item, or its refund.
The pictures of our electronic products are "suggestions of presentation", that is to say that the images do not always correspond exactly to the product that you will receive in the end, in particular in the case of the pre-orders, where the visuals are not always completed.
Article 9: Intellectual property
The materials supplied, including sales material, text, images, logo, icons, sounds, software, videos and all graphics are subject to copyright and the Copyright Act, Author. It is strictly forbidden to modify, resell or offer these elements (even partially) in any way, upon pain of prosecution.
The Customer can not claim intellectual or exclusive property in respect of any of the products or services sold by the Seller, whether modified or unmodified. All products and services are the property of the Seller. The buyer therefore acknowledges that, in the absence of express authorization from the Seller, any copy, partial or total distribution, exploitation, sale of an item present on one of the sites of PATRIMOLAND, even modified, will be such of any legal action taken by the Seller. Any reproduction, representation, modification, publication, adaptation of all or part of the elements of the site, whatever the means or the process used, is forbidden, without prior written authorization of PATRIMOLAND.
Any unauthorized exploitation of a site or any of the elements it contains will be considered as constituting an infringement and prosecuted in accordance with the provisions of articles L.335-2 and following of the Code of Intellectual Property.
Article 10: Protection of personal data
In accordance with the provisions of article 38 and following of the law 78-17 of 6 January 1978 relating to data processing, files and freedoms, you have the right to access and rectify personal data concerning you; By submitting your application in writing with your signature, accompanied by a copy of a valid identity document (signed by the holder of the document); And clearly specifying the address to which the reply should be sent.

- Delivery of content by other means than email
Some of our content (videos, tips, article links, commercial promotions) may be distributed via third-party sites, such as our Facebook page. By sending us your email address to receive our newsletters and content, you also give us permission to use this email address for the personalized targeting features on Facebook. This allows us to offer you personalized content. You can, of course, unsubscribe from our newsletters at any time.
Article 11: Monitoring of visits, hypertext links and cookies
Our sites may contain a number of hyperlinks to other sites, set up with our permission. However, PATRIMOLAND can not regularly check the content of the sites visited, and will therefore assume no responsibility for this fact.

Article 13: Applicable law
In the event of a dispute or claim, the buyer will address the seller in priority to obtain an amicable solution. All the clauses contained in these General Conditions of Sale, as well as all the buying and selling transactions referred to herein, will be governed by French law and the courts of our head office.
Article 14: Affiliation and Recommendations
In our newsletters, communications and training, we may recommend you tools, websites, products, or service providers that can provide you with a useful addition to our products, training or services. When this is the case, we are usually partners of the companies that market these products or services; So we get a commission if you decide to buy these products or services on our recommendation.
Article 15: Additional information
The SARL PATRIMOLAND is a SARL with a capital of 15.000 euros.
